Acceptable Use Policy

1. Purpose and scope

Fotenium is a business-to-business software service used by professional photographers to deliver finished work to their own clients through private, access-controlled galleries. Fotenium is not a consumer file-storage, file-sharing, or media-hosting service, and Fotenium galleries are not a public publishing platform.

This Acceptable Use Policy ("AUP") sets out what is permitted on Fotenium and how we handle reports of abuse. It supplements our Terms of Service and applies to every account holder and every gallery hosted on the service.

2. Who can use Fotenium

Account holders must be professional or semi-professional photographers (or studios) operating a photography business.
Account holders must be at least 18 years old, or the age of legal capacity in their jurisdiction.
One account per person or business entity. Sharing an account between unrelated photographers is not permitted.
Galleries are private by default and shared via photographer-controlled access. Fotenium does not provide a public feed, search, or content-discovery surface.

3. Permitted use

You may use Fotenium to:

Upload photography from commissioned shoots and personal portfolio work.
Deliver finished galleries to the clients who commissioned the work, or to designated recipients.
Run proofing and selection workflows with your clients.
Track gallery delivery, downloads, and selections for your own business records.

Fotenium's storage and bandwidth are sized for legitimate photography-business workflows. Patterns of use that are clearly inconsistent with a working photographer — for example, distributing a single gallery to thousands of unrelated recipients, or maintaining a constantly cycling archive of unrelated third-party content — are not permitted regardless of the headline storage limit on your plan.

4. Prohibited content

You may not upload, store, share, or distribute on Fotenium:

Illegal content of any kind under Finnish, EU, or applicable international law.
Child sexual abuse material (CSAM) or any content that sexualizes or exploits minors.
Non-consensual intimate imagery (NCII), including imagery shared without the depicted person's consent.
Hardcore or pornographic content.
Content that promotes terrorism, violent extremism, hate against protected groups, or incitement to violence.
Content that infringes another party's copyright, trademark, or other intellectual property rights.
Content that violates another person's privacy or publicity rights, including doxxing.
Malware, ransomware, or files designed to harm computer systems.
Content used to harass, threaten, defame, or impersonate any person.
Spam, phishing material, or content used to deceive recipients for financial gain.

5. Adult and boudoir content

Fotenium recognizes that professional boudoir, fine-art nude, and intimate portrait photography are legitimate categories of work. Such content is permitted on Fotenium provided that:

Every identifiable subject is at least 18 years old at the time the photographs were taken.
You hold a signed model release and consent form for every identifiable subject, and you can produce it on request.
The content is delivered through password-protected private galleries — not via public links.

Hardcore or pornographic content is not permitted regardless of consent. If the line is unclear for a specific shoot, contact mail@fotenium.com before uploading.

6. Consent and minors

If photographs include subjects under 18, you must hold a signed parental or legal-guardian consent form for every minor subject. Fotenium may request evidence of consent in response to a report or law-enforcement inquiry.

Photographs of minors must never be sexualized in any way. Any content that crosses this line will be removed immediately, the account terminated, and the matter reported to law enforcement.

7. Child safety

Protection of minors is non-negotiable. Fotenium will:

Remove suspected child sexual abuse material immediately upon discovery or credible report.
Permanently terminate accounts found to have uploaded such material.
Preserve evidence for law enforcement in accordance with Finnish and EU obligations.
Report confirmed CSAM to the Finnish National Bureau of Investigation Cybercrime Centre (Keskusrikospoliisi) and cooperate with other competent authorities.

If you encounter content that appears to depict child sexual abuse anywhere on Fotenium, report it immediately to mail@fotenium.com with the gallery link. Do not download or redistribute the material.

8. Reporting abuse

Reports of content that violates this AUP should be sent to mail@fotenium.com and include:

The URL or gallery link of the content.
A description of the violation.
Your contact information.
Any supporting evidence (for example, documentation of a copyright claim, or evidence of non-consent for an NCII report).

Response times:

Reports of CSAM and non-consensual intimate imagery: reviewed within 24 hours.
All other reports: reviewed within 72 hours.

Reports are handled in accordance with the EU Digital Services Act notice-and-action procedure. Repeated bad-faith reports may themselves be treated as abuse.

9. Copyright

If you believe that content on Fotenium infringes your copyright, send a notice to mail@fotenium.com including:

Identification of the copyrighted work claimed to have been infringed.
Identification of the allegedly infringing material on Fotenium (URL or gallery link).
Your contact information.
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate, and that you are authorized to act on behalf of the rights holder.

We will remove or disable access to content that is the subject of a valid notice and notify the affected account holder, who may submit a counter-notice. Repeat infringers will have their accounts terminated.

10. Enforcement

Where we determine that content or activity violates this AUP, we may:

Remove specific content.
Disable access to a gallery.
Suspend the account pending investigation.
Terminate the account.
Preserve evidence and refer the matter to law enforcement.

Enforcement is proportionate to the severity of the violation. Suspected CSAM, NCII, and credible threats of violence result in immediate removal and termination without prior notice.

11. Cooperation with law enforcement

Fotenium responds to valid legal process from Finnish, EU, and other competent authorities, including production orders, preservation requests, and emergency disclosure requests where there is a credible risk to life. We will challenge requests that exceed legal authority or seek information disproportionate to the matter under investigation.

12. Changes to this policy

This Acceptable Use Policy may be updated from time to time. The "last updated" date at the top of this page always reflects the most recent revision. Material changes affecting account holders are communicated by email.
