Acceptable Use Policy

1. Purpose and scope

Fotenium is a business-to-business software service used by professional photographers to deliver finished work to their own clients through private, access-controlled galleries. Fotenium is not a consumer file-storage, file-sharing, or media-hosting service, and Fotenium galleries are not a public publishing platform.

This Acceptable Use Policy ("AUP") sets out what is permitted on Fotenium and how we handle reports of abuse. It supplements our Terms of Service and applies to every account holder and every gallery hosted on the service.

Fotenium's storage and bandwidth are sized for legitimate photography-business workflows. Patterns of use that are clearly inconsistent with a working photographer — for example, distributing a single gallery to thousands of unrelated recipients, or maintaining a constantly cycling archive of unrelated third-party content — are not permitted regardless of the headline storage limit on your plan.

Fotenium recognizes that professional boudoir, fine-art nude, and intimate portrait photography are legitimate categories of work. Such content is permitted on Fotenium provided that:

Hardcore or pornographic content is not permitted regardless of consent. If the line is unclear for a specific shoot, contact mail@fotenium.com before uploading.

6. Consent and minors

If photographs include subjects under 18, you must hold a signed parental or legal-guardian consent form for every minor subject. Fotenium may request evidence of consent in response to a report or law-enforcement inquiry.

Photographs of minors must never be sexualized in any way. Any content that crosses this line will be removed immediately, the account terminated, and the matter reported to law enforcement.

If you encounter content that appears to depict child sexual abuse anywhere on Fotenium, report it immediately to mail@fotenium.com with the gallery link. Do not download or redistribute the material.

Reports are handled in accordance with the EU Digital Services Act notice-and-action procedure. Repeated bad-faith reports may themselves be treated as abuse.

If you believe that content on Fotenium infringes your copyright, send a notice to mail@fotenium.com including:

We will remove or disable access to content that is the subject of a valid notice and notify the affected account holder, who may submit a counter-notice. Repeat infringers will have their accounts terminated.

10. Enforcement

Where we determine that content or activity violates this AUP, we may:

Enforcement is proportionate to the severity of the violation. Suspected CSAM, NCII, and credible threats of violence result in immediate removal and termination without prior notice.

11. Cooperation with law enforcement

Fotenium responds to valid legal process from Finnish, EU, and other competent authorities, including production orders, preservation requests, and emergency disclosure requests where there is a credible risk to life. We will challenge requests that exceed legal authority or seek information disproportionate to the matter under investigation.

12. Changes to this policy

This Acceptable Use Policy may be updated from time to time. The "last updated" date at the top of this page always reflects the most recent revision. Material changes affecting account holders are communicated by email.
